Arkansas Superior Court, June Term 1820
The Grand Jury found a bill of indictment, against Robert C. Oden,
for
"having accepted a challenge to fight a duel with Capt. Wm.O.
Allen."
On Thursday evening last the trial came on. Procuring a competent
jury
produced some difficulty, as almost every person in the neighborhood
"had formed or delivered an opinion as to the guilt or innocence of
the
accused." After the jury were completed, it appeared that the
challenge
accepted (if any) was in writing; the prosecuting attorney not
having
the correspondence to produce, (which the court deemed to be the
best
evidence in the case), no parole evidence, to prove the acceptance
of the
challenge, was admitted; consequently there was no evidence to
support
the indictment. The jury retired, and in a short time brought in a
verdict
of "NOT GUILTY."
Could not a law be passed, making even a second a competent witness,
releasing his own guilt, when called upon by the prosecuting
attorney
to testify? Our statue inflicts no other punishment but fine and
disqualification from office &c for giving or accepting a challenge
even where death ensues in consequence.
Elijah Morton and George W. Scott were also indicted for being
engaged
in the above duel, as seconds. The trial of the former came on
yesterday
morning.
